No contract shall arise between you and the Travel Provider until Cassidy Golf
a) Has confirmed the booking with the Travel Provider on your behalf.
b) Has received your authorization to book the travel arrangements as your agent.
It is your responsibility that you check all names, dates and timings are correct on receipt of all documents and advise Cassidy Golf of any errors immediately. Please ensure that the names given are the same as per the relevant passport. Any changes to these details will incur amendment fees charged by the Travel Provider. Where there is more than one traveller in a booking, the person who makes the booking and signs the booking conditions, accepts these conditions on behalf of all members of the party and is responsible for all payment due from the party. It is your responsibility to ensure that any information given to you by us or any of our employees or Travel Providers is passed onto all members of the party.
Although we will endeavor to pass on any reasonable request to your Travel Provider, we are unable to guarantee that the request will be met.
All prices quoted are stated in Euros and are based on tariffs and exchange rates current and appropriate at the time of publication. If any of these vary the cost of the travel arrangements may increase accordingly. Any such increase must be paid by you to Cassidy Golf.
(a) Certain airlines do not maintain ‘real time’ seat availability in the airline reservations system to which we connect. Whilst every effort is made to reflect the true situation, instances may occur when airlines cancel reservations. Cassidy Golf will advise you if this is the case and we will do all we can to re-instate your booking, however, this may be at an increased cost to you.
(b) Some airlines may have code share agreements with each other, which may result in a different partner airline flying the route with a different aircraft seat configuration.
(c) It is your responsibility to present yourself at the port of departure in sufficient time prior to the designated departure time to complete embarkation requirements and to ensure you are in possession of all relevant travel documentation ie. Passports, Visas
(d) Regulations of individual airlines, cruise ships, vehicles and executive authorities restrict the weight, type and contents of baggage which may be taken on board the craft and/or vehicle. It is your responsibility to ascertain any limits or prohibitions which apply in this regard.
(e) It is your responsibility to abide by the instructions or directions given by a Travel Provider’s employee. By agreeing to these terms and conditions you agree to indemnify Cassidy Golf against any loss or injury suffered or incurred by any other person as a consequence of your failure to act in accordance with any such direction or instruction.
(f) Pursuant to Regulation EC261/04 airline passengers are granted new rights including, in certain circumstances, the right to cancel their flight and receive reimbursement of the cost for the flight from their airline. Full details of these rights will be publicised at EU airports and will also be available from affected airlines. The reimbursement of the cost of a flight that forms part of your travel itinerary does not change the booking conditions of the other travel arrangements.
All onward and return flights must be reconfirmed with the relevant airlines at least 72 hours prior to the commencement of that leg of the journey unless specifically informed otherwise by that airline. Cassidy Golf accepts no responsibility for bookings cancelled due to non-compliance with rules set by that particular airline. Cassidy Golf also accepts no responsibility for any flight rescheduling en route.
All documents will be sent to you by ordinary post or email to the address you provide. Once documents leave our office Cassidy Golf cannot be held responsible for their loss, unless the loss is due to our negligence. Cassidy Golf cannot be held responsible if the documents do not arrive due to an incorrect email address you have provided or due to Spam email settings on your computer or if for any reason documents fail to print on your printer. If your travel documents have to be re-issued any incurred costs must be paid by you.
Cassidy Golf can provide general information about the passport, visa and health requirements for your trip. It is your responsibility to ensure you meet the specific passport, visa and health requirements of the countries you visit, and those that you transit (even if it is for a plane change). Many countries now require passports to be machine readable and valid for at least 6 months after your return date. All adults and children under the age of 16 require individual passports. You should check with your own doctor for your specific health circumstances. Cassidy Golf cannot accept responsibility if you should be denied boarding or deported due to non-fulfilment of the above.
For the avoidance of doubt, your booking is directly with the Travel Provider and Cassidy Golf accepts no liability or responsibility for any aspect of your travel arrangements.
(a)Whilst we have chosen our Travel Providers with care, we have no control over them and so cannot be held responsible for any action or omission of the Travel Providers or their servants or employees. Moreover, we cannot be held responsible for any loss, damage or expense caused by strike, civil commotion, fire, war, threat of war, terrorist activity, national, natural or nuclear disaster, late delivery, adverse weather conditions or other force majeure or relevant factors which may impact on the services or products of the Travel Providers or of Cassidy Golf for any reason whatsoever. In no circumstances shall we be liable for any consequential loss or damage. In all cases the absolute maximum liability of Cassidy Golf is the total price paid by the customer for the specific bookings related to any given complaint.
(b) Persons with Disabilities:
It shall be your responsibility to disclose prior to booking any physical or mental condition of a member of the party which may be relevant to the travel arrangement. Cassidy Golf accepts no responsibility for any travel arrangement where no disclosure of a physical or mental condition has been made to us or the Travel Provider. Cassidy Golf reserves the right to decline a booking for a person with disabilities where in Cassidy Golf’s opinion that travel arrangement would be inconsistent with the special needs of a person with disabilities.
(c) Time Limit for Action.
Any action in court to claim damages must be brought within 2 years from the date of arrival of the aircraft, or from the date on which the aircraft ought to have arrived.
(d) Basis for the information: The basis for the rules described above is the Montreal Convention of 28 May
1999, which is implemented in the Community by Regulation (EC) No. 2027/97 (as amended by Regulation (EC) No.889/2002 and national legislation of the member states). A copy of the conditions of carriage applicable to the holiday and the Convention referred to above can be supplied on request. In any event of any liability on the part of the Travel Provider for injury, illness or death, no payment will be made unless the following conditions are complied with:
(1) You must advise the Travel Provider in relation to the injury or illness whilen you are at the resort and must also write to the supplier within 3 months of the completion of the travel arrangement;
(2) You must transfer any rights that you have in respect of such injury, illness or death against any person to the Travel Provider.
(3) You must co-operate fully with the Travel Provider to enable the Travel Provider or its insurers to enforce such rights.
Covid-19 Disclaimer:
As all travellers are knowledgeable and aware of the situation following Covid-19, of the uncertainties, restrictions and cancellation policies that apply, we will not accept cancellations, except where new restrictions, quarantines, lockdowns, states of alarm etc., have been declared due to new Covid-19 outbreaks, which prevent travellers from reaching their destination. It is your responsibility, prior to travel, to familiarise yourself with restrictions/quarantines etc., in the country you chose to travel to and whilst we will provide information where possible it is important to refer to the DFA’s website for up to date information.
Likewise, it is important to remember that, due to the measures and guidelines which have been and may, in the future, be implemented by governments across the globe, it is possible that not all of the facilities and services will be available. Linevana Limited, trading as Cassidy Golf cannot accept complaints and claims for any lack of service or limitations due to the exceptional circumstances caused by the pandemic.
If you have any dissatisfaction in relation to a service provided by one of our Travel Providers this must be first reported to the Travel Provider or their representative at the time and location when the complaint arises. If your complaint is not resolved locally and you wish to make a formal complaint upon your return home, then this should be done in writing not later than 28 days after your return to the port of departure or termination of the holiday whichever is the earlier. You should assist the Travel Provider and Cassidy Golf in all reasonable ways in the investigation of the complaint, both during and after the holiday. A reasonable period of time within which to investigate and respond to any written complaint should be allowed to Cassidy Travel and the Travel Provider, before any legal proceedings are initiated by or on your behalf.
The terms of the contract for Cassidy Golf Booking Conditions are to be interpreted under and are subject to the laws of the Republic of Ireland.
(a) If your booking is with a Tour Operator; payment is as per the schedule of the Terms & conditions of their Booking Form which you have signed.
(b) If you have booked your travel arrangements through Cassidy Golf, full payment is required 12 weeks before the scheduled date of departure.
(C) Deposits & 3rd Party Deposits are non-refundable.
(d) Instant Purchase Flights must be paid in full at the time of booking.
As a result of new security systems in place with all scheduled airlines, name changes are strictly not allowed and we are unable to provide the facility of name changes for any airline tickets. Where a flight booking is made with an online Travel Provider, name changes and appropriate fee may be permitted at their discretion.
We cannot recommend strongly enough the importance of taking out adequate
travel insurance. Many Travel Providers require you to take out travel insurance
as a condition of booking with them as detailed in their booking conditions. In
any event, we strongly advise that you take out a policy of insurance in order
to cover you and your party against the cost of cancellation by you; the cost of
assistance (including repatriation) in the event of illness; loss of baggage and
money; and other expenses. If we have arranged your policy please check it
carefully to ensure that all details are correct and that all relevant information
has been provided by you (eg. pre-existing medical conditions). Failure to
disclose all relevant information will affect your insurance. In arranging any
insurance cover, Cassidy Golf is acting as your agent for the relevant insurer and
shall not be responsible for any default by the insurer under that policy.
Cassidy Golf is committed to protecting your privacy and information. A copy of our privacy policy is available on request. Information that you provide us with will be held on Cassidy Golf computers (and in other ways) for use by us for the following purposes.
(1) Booking Information.
(2) The booking information that you provide to us about you (and your travelling party) may be passed on to the relevant Travel Providers of your travel arrangements or other persons necessary for the provision of your travel arrangements. The information may therefore be provided to public authorities such as customs or immigration if required by them, or as required by law. This applies to any sensitive information that you give to us such as passport details, religious beliefs, dietary requirements and disabilities. If we were not authorised to pass on this information to the relevant Travel Providers, whether in the EEA (European Economic Area) or not, we would be unable to arrange your booking. In making this booking you consent to this information being passed onto the relevant parties.
(3) The booking information may be passed onto security or credit checking companies or to our agents for the purpose of Fraud prevention and or debt collection.
(4) To contact you via email, letter or phone with details of our selected Travel Providers products which may be of interest to you. A copy of your personal information held by us can be provided on request. You have the right to have any inaccurate information rectified or erased.
We are obliged to inform you, at the time of booking, of the identity of the operating air carrier(s) which is due to perform, or likely to perform your flight; if there are any changes to the operating air carriers we are obliged to inform you of these as soon as possible. If we don’t know the identity of the operating carriers when you are booking we must inform you when it is known, In call cases we are obliged to inform you of the identity of the operating air carrier at check-in or boarding, where no check-in is required for a connection flight. In accordance with EU Dir No. 211/2005 we are required to bring to your attention the existence of a ‘Community Blacklist’ which contains details of air carriers that are subject to an operating ban within the EU Community. Any changes to the actual airline after you have received your tickets will be notified to you as soon as possible and in all cases at check-in or at the boarding gate.
